Appeals Court Sides with Apple in Dispute over Psystar's Unauthorized Mac Clones

It has taken nearly two years, but CNET reports that an appeals court has ruled in favor of Apple in its lawsuit against Psystar, a company that began selling unauthorized Mac clones back in 2008.
Circuit Judge Mary Schroeder ruled yesterday that Psystar's Mac clones violated copyrights Apple holds, and its ban on sales will be upheld. According to Judge Schroeder, Psystar specifically violated copyrights Apple holds in Mac OS X, and said that the U.S. District Court's ruling in favor of Apple was just.
Apple was awarded a permanent injunction against Psystar in December 2009, but Psystar appealed the decision to the U.S. Court of Appeals for the Ninth Circuit a month later.

Psystar's 2009 last-ditch effort to raise funds for its legal fight against Apple

Psystar was unusually defiant in its stance against Apple given the threat it faced from the substantially larger company, and extended its legal efforts well beyond what most small companies would typically be willing to engage in. Those efforts lead Apple to suggest that Psystar could have been part of a conspiracy with the backing of a larger entity attempting to break open Apple's stranglehold on Mac OS X systems, but no concrete evidence of such a connection has ever been exposed.

10.7: View Linux SMB servers in Path Finder

I use Path Finder for some fancier features, but since upgrading to Lion, I could not see my Linux SMB server in the side panel. After waiting for their Lion patch with no change, I figured out a very simple solution.

For whatever reason, Path Finder can't find or list Samba servers like it did in Snow Leopard. But, if you either install or modify an Avahi daemon on the SMB server, and advertize SMB services, Path Finder will see the server again.

After installing the Avahi daemon in a manner appropriate for your distribution, just create and save this simple file to /etc/avahi/services (on the server):
 <?xml version="1.0" standalone='no'?> <!DOCTYPE service-group SYSTEM "avahi-service.dtd">     Samba Share ...

iPad production is just fine, says All Things D

Yesterday there was a small panic around the web when Bloomberg noted a report by Hong Kong-based J.P. Morgan analyst Gokul Hariharan who noted that Apple supposedly cut its fourth quarter orders for iPad components by 25%. Such a component cut could mean that iPad 2 sales were in trouble.

However, that's probably not the case. Today, AllThingsD noted that Sterne Agee's Shaw Wu has issued a research note saying that build plans for the iPad 2 remain "well above expectations," and expects that any production cuts should be no cause for concern:

"From our understanding, these production cuts are due to much improved capacity and Apple actively managing its inventory in front of what is likely an iPad refresh in the March quarter. The iPad 2 started shipping in March 2011 making the product likely due for an update near its 1-year anniversary. We would also like to remind investors that production changes are common throughout a quarter and through the lifecycle of a product."

Wu went on to say that distributor checks of iPad 2 sales indicated demand of the device remains strong. He also reiterated his iPad shipment estimates for Q4 2011 (which ends on Friday) of 12 million iPad 2s sold and the holiday quarter's Q1 2012 shipments of 15 million iPad 2s.

iPad production is just fine, says All Things D originally appeared on TUAW - The Unofficial Apple Weblog on Tue, 27 Sep 2011 15:00:00 EST. Please see our terms for use of feeds.

The Daily musters just 120,000 weekly readers half a year on

The Daily's readership figures are less than a quarter of what they need to be to break even, Publicis Groupe executive VP John Nitti revealed in a discussion Wednesday. Relaying what it had heard directly from News Corp., the advertiser told Bloomberg that about 120,000 unique readers, which could include those on two-week trials, were being tracked every week. News Corp. chief Rupert Murdoch had said during the launch event that about 500,000 were needed to break even....
